Landmark rulings on vaccine injury

UK The mother of a Cheshire teenager, Robert Fletcher, who was left severely brain damaged by the MMR vaccine has won a compensation award from the government.  He endures frequent epileptic fits and requires round-the-clock care from his parents Jackie and John, ….a medical assessment panel consisting of two doctors and a barrister has concluded that MMR was to blame.  Mrs Fletcher set up and runs the amazing pressure group

USA The first court award in a vaccine-autism claim is a big one.  Hannah Poling received 5 shots to protect against 9 diseases on a single day.  It was found that “The MMR aggravated an underlying condition“.  The compensation could easily amount to $20 million over the child’s lifetime. Hannah’s father is a neurologist and her mother a registered nurse, now an attorney.  They had the confidence and knowledge to battle for their daughter.   Unfortunately now in the US as well as in the UK, any diagnosis of Autism makes a hearing even less likely and recently 5,000 similar cases were thrown out of court by the federal vaccine court in the US.

Julia a three year old US citizen has just won substantial compensation in the US Federal Court for autism caused by MMR vaccine – says her mother.

What is different about this case?  They kept the “autism” word out of the case.  Many parents in other  US cases have been advised to do this:-

“1 week past her 1st b-day, our family’s lives changed forever. Julia had been seizing most of the night, was transported to the nearest ER for stabilization, and then airlifted to Miami Children’s hospital, where she stayed in PICU and the neurology ward for nearly one month. Her diagnosis? Encephalitis (inflammation of her brain) most likely attributed to the MMR-V (measles, mumps, reubella, chicken pox) vaccine she had received nine days previously.”

Since 1988, the US vaccine court has awarded money judgments, often in the millions of dollars, to thirteen hundred and twenty two families whose children suffered brain damage from vaccines. In some cases, the government paid out awards following a judicial finding that vaccine injury lead to the child’s autism spectrum disorder.   In each of these cases, the plaintiffs’ attorneys made the same tactical decision made by Bailey Bank’s lawyer, electing to opt out of the highly charged Omnibus Autism Proceedings and argue their autism cases in the regular vaccine court

The Vaccine Court, in other words, seems quite willing to award millions of dollars in taxpayer funded compensation to vaccine-injured autistic children, so long as they don’t have to call the injury by the loaded term “autism.”

POLIO – why is it still in the vaccine program?

“Since 1979, the only cases of polio in the US have been associated with the OPV – oral polio vaccine.  The Western Hemisphere was certified by the WHO as polio free in 1994 and no cases of wild polio have been reported in the region since 1991″.

Have vaccines eradicated Polio?    Do we still need this vaccine in our programs?  Worldwide only a few hundred cases are reported at the cost of 1.3 billion dollars to date.
